The Los Angeles District Attorney announced the news Tuesday that
Mischa Barton is to be charged with four misdemeanor counts: driving under the influence, driving with a blood alcohol level of .08% or higher, driving without a license and possession of marijuana (under an ounce) following her December 27, 2007 arrest in West Hollywood.

Cops said she “was seen straddling two lanes of traffic and failed to signal when making a turn.” When deputies pulled her over, they determined that she “was an unlicensed driver and was driving while under the influence of an alcoholic beverage.”

She was released on bail and has since apologized for her actions. She stated she was wrong to attempt to drive home after partying with pals. The 21-year-old has confessed she didn’t have a driving license because she rarely gets behind the wheel.
She said, “I’m really disappointed in myself. I’m not perfect and I don’t intend to do anything this stupid again.”

Her next court date is February 28.
